It is important that you read and understand these terms and conditions before proceeding with this transaction. Only proceed with this transaction if you wish to be bound by the terms and conditions set out below.

These terms set out all the terms of agreement other than price between you as buyer and us a seller, in relation to the sale and purchase of the item(s) indentified in the invoice, which we refer to as the "title" (the contract). We confirm that we either own the "Title" or are authorised to sell it on behalf of the owner. If you wish to rely on any variation of, or addition to these terms, you must ensure that the variation or addition has been agreed by us in writing.


Product

Antiques by defintion are old and show wear and age, (or patina as it is known), this sense of history along with the unique designs and craftsmanship is part of the appeal. We only sell antique items that are in good useable condition. All items will have gone though our workshop for a thorough check, with any necessary restoration already undertaken. Should you wish to buy from us, your purchase will be fit for purpose, unless otherwise stated. All goods are sold as seen at our premises. While we may supply photographs, measurements, drawings, these items are for indentification and reference purposes only, purchasers are advised to examine the goods as to their condition, dimensions and quality, before purchase, and the vendor gives no warranty or guarantee in respect therof.

Every effort is made to ensure that all product images appear as realistic as possible. However, due to the constraints and variations in digital reproduction we cannot guarantee an exact colour depiction. Every care is made to ensure that our descriptions and measurements are as accurate as possible, however so variations may occur.


Payments & Prices

Prices are exclusive of delivery and shipping. For overseas orders pro-forma payment is required prior to their removal from the vendors premises, or the appointed shipping agents premises. All goods are sold subject to the understanding that the title does not pass to the purchaser until the goods have been fully paid for. Responsibility for the saftey and security of goods pass to the purchaser as soon as the goods are removed from the vendors premises, and the purchaser will indemnify the vendor against all liability whatsoever arising after such removal. You must pay us the full price for the Title, (without deductions), together with delivery costs, and any amounts payable to us but excluding any deposit or advance that you may already have paid (The Price), on earlier of the expiry of any payment term as shown on the invoice, and the time of delivery of the Title. Payment is only made once we recieve cleared funds representing the full amount.

Payment may be made by wire transfer, cash (subject to any thersholds we may set), or credit card, as agreed and set out in the invoice. Where we agree to payment by cheque, acceptance is conditional upon the cheque being cleared in full on first presentation. All payment shall be made in the currency specified in the invoice.

You must collect the Title from the address specified in the invoice at the agreed date and time, within 28 days of the date of payment, unless it is agreed in writing that we should deliver it to you or risks of loss and damage to the Title shall pass to you on the time and date agreed for collection or delivery of the Title. From the point at which risk passes to you, you are responsible for the Title against all risks, including during collection or transit.

Delivery

Whilst delivery can be arranged on behalf of the purchaser to transport goods ordered from the vendors premises, the carrier does so as a contractor of the purchaser, not the vendor, whether the cost is invoiced by the vendor, or by the carrier. Any disputes concerning carriage are therefore to be conducted by the purchaser with the carrier, and the vendor accepts no liability arising out of the appointment of such contractor. Items damaged in transit must be notified within 24 hours of receipt of the goods with photo evidence and emailed to info@lionheart-interiors.co.uk

Refund

We are happy to offer a full refund or exchange on all items. As part of our returns policy we must be informed, either by e-mail or telephone, the notice to return an item within 48 hours from the delivery date. Returned goods must be delivered to us within 14 days, (unless otherwise agreed), and must be received in the same condition as originally sold. We will make the reimbursement without undue delay and not later than 14 days after the day we recieve back from you the Title, or (if earlier) 14 days after the day you provide evidence that you have returned the Title, or if the Titke was never supplied, 14 days after the day on which we are informed about your decision to cancel the contract. We will make the reimbursement using the same means of payment as you used for the inital transaction, unless you have expressly agreed otherwise, in any case you will not incur any fees as a result of the reimbursement. Unless we are collecting the Title, we may withhold reimbursement until we have received the Title back or you have supplied evidence of having sent back the Title, whichever is sooner. Refunds on items exclude shipping costs. Return postal, shipping or courier charges are incurred at the purchasers own expense. All initial shipping costs, including packing and insurance are non-refundable. Items damaged in transit must be documented (i.e: photographed) on delivery and e-mailed to info@lionheart-interiors.co.uk within 48 hours. All original shipment wrap and packaging must be kept in order to process a successful compensation claim. Nothing in this section affects your legal rights.

Consumer Protection

To exercise your right to cancel, you must inform us of your decision to cancel by a clear statement, (by post or e-mail), sent prior to the expiration of the cancellation period. If you cancel the Contract, you must also return the Title to us by hand, courier or recorded mail to the address as set out on the invoice at your own cost within 14 days, after the day of notifying us of the cancellation unless the Contract was concluded "off-premises" and the Title cannot by its nature be returned by post in which case we will collect the Title at our own expense. The Title must be returned to us in the same condition in which you received it (which does not interfere with your rights to take any reasonable steps to examine the Title). You have a legal obligation to take reasonable care of the Title whilst it is in your possesion. If you fail to comply with this obligation, we may make a deduction from the reimbursement you are entitled to for the loss in value of the Title.

Notices

Any notice to be given to us or that we must give to you in connection with the sale of the Title must be in writing and must be sent by post, oe delivered by hand, to our address or to your last known address as set out in the invoice or as notified to us by you as the case may be.

Privacy

We repect your privacy rights and all of our customers records are private, confidential and secure. When submitting your e-mail or payment details, your information will not be passed on to any third parties.

Copyright

The copyright subsisting in all images and other materials produced for the sale of the Title is owned by us and such images and materials may only be used with our permission. We will have the right to use such images in our own discrection after the sale of the Title. During the period in which the Title is protected by copyright, the copyright remains with its author (or any person to whom that right has been assigned). You are purchasing the Title, but not the right to produce copies of the Title (including photographs therof), for publication. If such rights are sought you should contact the copyright owner.
